If there are enough facts and past decisions that show it’s likely that the plaintiff did not meet their burden of proof to file a defamation claim, it’s a matter of judicial efficiency and economy.
The court gets these claims all the time and aim to only let the arguments with merit survive a 12(b)(6) motion, which UMG filed here.
