Two major holdups in general, price negotiation and whether the artist will even allow the sample (certain artists and artists from specific countries, tend to almost never let their music be sampled). Second point to the second one is if the sample is actually transformative or not, some artists care that itās not just ripping off their work point blank and others just want the check.

most artists do not pre-emptively get permission to actually use samples, so they just use them and then figure out the legal stuff later. this leads to a huge headache when it comes to clearance, since not only do they need to find the rights holder and negotiate clearance with them, but they also need everything to go through all associated parties - so all labels, publishers, distributors, etc. signed onto it and on the same page
