OVOJerseyWell first they would file a motion to dismiss in the claim they are currently in.. then if they wanted to sue someone for a frivolous suit they could sure but this doesn't read like a complaint that's going to meet the standard of frivolous/bad faith claim "claim is frivolous when the claim lacks any arguable basis either in law or in fact". The petitions here don't read as lacking in law and in regards to any gaps in facts they literally asking for discovery for that very reason. I think they'll just shoot for a motion to dismiss and if it fails settles but who knows Lucian's a bit of a legal dog

Bro civil procedure f***ing SUCKS every law school first year (1L) has nightmares about their civ pro exam (if they don't they likely a weird introvert type lolol).. it's all about how to file suits, counterclaims, move into federal, joinder another party, 3rd party suits, it's for sure wild
It's def cool you get that tho cuz most ppl don't understand you can't just be an absolutist in the law cuz people can take what you say and turn it into 3000 different meanings lol that's why precedent and standards are so important

Yeah I don’t do audit defense at my job but I work pretty closely with our audit defense team to make sure we are following IRS code, etc. so I know enough to be dangerous that’s about it 😂
