It would be much better if he got a maximum sentence on a 2nd degree charge, then have the possibility of the f***ing jury letting him walk away because they cant "technically" prove he had intent to murder with a 1st degree.
I don't know how to feel about this. On one hand he'll get a harsher sentence if found guilty, on the other hand it's going to be much harder to get a guilty verdict and the chance he'll walk free is much higher
