It wasnt utilized opportunistically tho its the actual word in the constitution. “All persons born” if they meant just slaves that would have been the wording. If that’s what they meant the courts would have set that precedent. If you look at their challenge to it it’s not even based of off of the argument that it wasn’t intended for immigrants. They are challenging the meaning around the word “jurisdiction” saying children of immigrants are not under US jurisdiction due to not being citizens
