It feels to me like that standard is only applied sometimes. All artists repurpose stuff one way or another. And according to free use laws, as long as a work is transformative, it’s okay
Why can a youtuber repurpose film footage with commentary under fair use but a song that uses 3 seconds of a piece along with other samples and original instruments and vocals and possibly pitch shifting or other effects would be not considered under this law?
The answer is simple, because the labels and lawyers campaigned for it to be that way in court. I understand y’all pro artist angle but sampling is fair use I’ll die on that hill
