Over here in South Africa, there was a landmark case in the 90s where a guy penetrated a 10 year old girl's anus without her consent. But because the definition in the Act only provided for penetration of a vagina, he couldn't be found guilty of rape and had to be charged with sexual assault. The Act has since been amended
By your logic, you can forgive this guy because he wasn't found guilty of rape in the legal definition. These definitions change over time, it's not even a reach to consider stealthing rape. If people want to call this rape and your first reaction is "Well, actually..." that's f***ing weird.
