Yes, US courts have ruled for decades that the constitution only applies to citizens. Handling of non-US citizens (even if they are here legally via visas/etc) is essentially done on "we are granting this to you " basis instead of US citizens where rights are believed to be inherent/natural. This has resulted in a substantial amount of weird rulings in the past.
