one has to do with the existence of judge jury executioner being a problem at all, the second has to do with whether or not it has a mutually exclusive relationship with the castle doctrine. the second literally presumes that the first argument is already resolved, because for something to even have (or not have) a mutually exclusive relationship with anything, it has to exist and be a thing.
