I haven't read the amended response yet, but I continuously find it entertaining how fans, with a fresh and limited understanding of law, continue to label each ruling on a motion as a "win."

To keep everyone on track, the first "win" that will matter will be if Drake's lawyers can meet the required legal standard by showing they pleaded sufficient facts for the defamation claim. This standard is higher for public figures based on common law. So Drake's team will have their work cut out, even with discovery. They could do it, but we won't know until June 30th.

Until then, both sides are going through the standard procedural motions and arguments. Everything else that fans are grabbing onto really doesn't matter and are incomplete opinions.

Wonder why Drake hasn't pushed to sell physicals and do the whole bundle s*** UMG is notorious for

Are you talkin about this last album or in general? Because $$4U had physicals and even his last solo joint had physicals

You don't get "granted discovery", it's the norm when a matter proceeds to trial. Literally received a Discovery Notice a few hours ago in a divorce I'm doing. Drake didn't win anything and it doesn't say anything about his evidence by discovery being allowed to proceed

This much is clear. Drake's legal team are aiming for this to go to trial and until/unless that happens, this would have all been for nothing.

I'm surprised by the lack of quality in the statements and legal arguments being made by a team that a +$50 billion company has picked

Same here. I don't know why their representation thinks making statements like this are useful or help in any way.

If the judge denies the motion to dismiss, UMG will likely file a motion for summary judgment, shifting the burden to UMG to show the court there is no genuine issue of material facts in Drake's claim. If UMG can meet that burden, then there is no trial.

We have many more steps to take before this goes into trial.

Not to go to deep into conspiracy theories, the reason this stupid lawsuit is dragging on so much is because it’s a distraction

Why did umg make that awful response to this today? Doesn’t the phrasing make them look guilty?

It's not. A case wouldn't have legs if that was your sole evidence but it is absolutely something they can and should use among other things. They will have to prove that the slanderous lies that UMG spent a lot of money on promoting have affected his public perception - internet views and comments are a part of that. They will obviously also have to include other aspects such as brand deals, shows and everything related to his businesses, but you are out of touch if you think that a judge won't admit those as evidence.

Not going to read all these papers, have enough work of my own to do that actually gets me a bag. But I wouldn't rely on random comments made by people on the internet, which might ironically be bots themselves, unless I didn't have enough evidence of a nature like you mentioned (deals, sponsorships etc)

"Fama" = reputation, your good standing in the community. Defamation is obviously the degradation of that. Saying "These random people on the internet, which might not actually even be people, said this about me" is weak evidence. How tf can you prove actual harm/loss you suffered because random people on the internet said mean things about you?

Truth is also an established defence to defamation. Kendrick Lamar didn't create the narrative that Drake is a pedophile, it was already in existence and Drake himself mentioned it on Taylor Made. This suit is confusing because there's defamation, bot allegations and he's suing UMG instead of the person who made the song. But looking at it solely from a defamation point of view, it's not a good idea to rely on random YouTube/X/IG comments

Why did umg make that awful response to this today? Doesn’t the phrasing make them look guilty?

I'm exactly sure, but the phrasing doesn't do much for the court.

Like most corporations, UMG doesn't want this to go to trial. Litigation is always expensive and time-consuming.
The firms that both Drake and UMG hired will cost each party millions, and a dispute that could take months to a year to decide will cost each party millions.

Business-wise, UMG probably still has an interest in mending the relationship with Drake, even after this. He is one of their highest-grossing artists, and Drake's recent move to co-release $$$ with Sony means that UMG is having a piece of their revenue cut into (although all the Drake-only songs are more likely under UMG's royalty only).

Last, it sets a bad precedent for labels and would change their roles with artists. They may have to conduct business differently (change contracts for potential future conflicts like this with artists, limits on promoting a hit song, etc.). So, it could be used to deter others from engaging in anything like this in the future.
