AUSA: We think they have opened the door to Jane's prior consistent statements, her notes before November 2024 when she got immunity for her grand jury testimony.
Combs' Jason Driscoll: They are not prior consistent statements.

Daphne 100% is reluctantly testifying to stay out of prison that's so crazy

She literally broke down in tears over diddy being the reason why her son is happy.

Between her and Cassie's testimony, I don't think the prosecution is going to land the plane on the s***trafficking.

Both broke up with Diddy plenty of times, and were free to leave (Cassie is a bit more arguable in this regard) and based on what we've gathered, Daphne, Cassie were far more upset with Diddy's infidelity than being involved in FO's. The DV almost is always attached to fights regarding jealousy, and infidelity.

Daphne even testified to being jealous of the Young Miami relationship.

Just because you don't want to always have FO's, and are scared he's going to leave you if you don't do them, doesn't mean you're forced to have FO's. Daphne literally left Diddy and blocked him multiple times.

The s***trafficking is weak.

The Racketeering, and Transportation of prostitutes though are slam dunks. The prositution charge, duh and the Racketeering is (probably) there. (Although, it's kind of shaky) You have the d*** trafficking, potentially the bribery, potentially the arson, etc.

Cassie wasn’t free to leave. Not sure how anyone got that out of testimony

Combs' Teny Geragos: We shouldn't have it. It's consistent with our theory. They opened-
Judge: They didn't open the door.

AUSA Comey: On direct, we elicited testimony about the end of the relationship in 2024. There were no texts, but oral communications. This self-serving voice note by the defendant should not come in. By December 2023 he was trying to make a record for litigation

Judge: What about Ms. Geragos questioning Jane about this, without introducing the voice note?
AUSA Comey: That too might confuse the jury. The defendant was trying to feed Jane a narrative throughout their relationship. The hearsay rule precludes this

AUSA Comey: If the defendant wants to take the stand and subject himself to cross examination, then fine.
Judge: The questions without the voice note would not be for the truth [of the matter asserted]
AUSA Comey: This would be a backdoor way to get this in

Judge: So I agree with the Government on those portion of the voice notes, and order them excluded. Some questions will be permitted. If you feel there become a basis for introduction, you can call for a sidebar.

Judge: Once there is a motive to fabricate, the statements cannot come in as a prior consistent statement. This fact pattern does not appear to have previously arisen: two time periods. Defense argues it would be improper, they postdate the lawsuit
