[They're back]
Combs' Steel: Nothing further.
Judge: Member of the jury, do not consider any of the testimony about this witness' communication with her therapist. Ms. Smyser?
AUSA Smyser: Mia, was posting to social media part of your job?
Mia: Yes.
AUSA: As part of that did you post on your personal Instagram account?
Mia: Yes.
AUSA: What did Mr. Combs do if he thought you were not doing your job?
Mia: I'd be yelled at and humiliated.
AUSA: Did other employees also post for Mr. Combs' birthday?
Mia: Yes
AUSA: The birthday video, was it for Club Diddy?
Mia: Yes.
AUSA: Did Mr. Combs' co-own the water you were drinking, and did you say Revolt - the project you worked on - at the end?
Mia: Yes.
AUSA: You posted about the good not bad times?
Mia: Yes.
AUSA: Why did you want to make the person who abused you happy?
Mia: When he was happy, I was safe.
AUSA: Were you worried about your physical safety?
Mia: Yes. I'd been abused by Puff before. I knew his wrath.
AUSA: Did you engage a pro bono lawyer?
Mia: Yes.
AUSA Smyster: Why did you meet with the government so much?
Mia: So my story could be understood.
AUSA: Why were you terrified?
Mia: Of Puff and the repercussions.
AUSA: Did the Government tell you want to say?
Mia: No. Only to tell the truth.
AUSA Smyser: How do you feel about public speaking?
Mia: Terrified.
AUSA: Can you explain that, given that you've been in comedy?
Mia: I had Puff's permission for that.
AUSA: Any comparison to testifying about Mr. Combs' sexually assaulting you, here?
AUSA Smyser: Why are you here today?
Mia: If not I couldn't look my god daughters in the eye & ever advise them what to do in this situation
Judge: Mr Steel, any re-cross?
Combs' Steel: No, sir.
Judge: Mia, you may go. Unless you want to stay.
[Smiles. Mia leaves]
Judge: Next witness.
AUSA: The Government calls Sylvia Oken. Where do you work?
Oken: The Beverly Hill Hotel, for 17 years. I'm the director of sales and marketing.
AUSA: How do reservations work?
Oken: A system called Opera
AUSA: Does Opera link a customer's alias to their real name?
Oken: Yes.
AUSA: And this one, who is it, really?
Oken: Sean Combs.
AUSA: Can a guest change his or her alias?
Oken: Yes.
AUSA: How is this paid for?
Oken: It's to tfletcher at Bad Boy; paid by AmEx of Sean Combs.
AUSA: What's this?
Oken: The folio or bill, for room 259. AUSA: What's his?
Oken: A $500 charge for oil damage
AUSA: No further questions.
Cross
Defense: The accompanying guest was Cassie Ventura?
Oken: Yes.
Defense: Nothing more.
Judge: Is that a good place to let the jury go for the day?
Yes? OK, jurors, see you tomorrow.
[Jurors leave]
Judge: Who's next?
AUSA: Eddy Garcia, for an hour and a half. Then, we think, the video expert. Witness Jane will be having an international flight so we'll try to get her on before
Courtroom deputy: Marshals, can you bring the defendant out? Oh, I think Mr. Donaldson is in there [the holding cell] with Mr. Combs.
[Combs is brought in]
Judge Subramanian: Let's start with the compilation video. I got this letter
Judge: Is Mr. Garcia competent to testify about this video, given his position in the hotel's security?
AUSA Steiner: I have not really asking him about that aspect.
Judge: We are not using the correct cell phone video, so this could get in under the rules.
Combs' Teny Geragos: The way the video is cut makes it appear that Mr. Combs came right after Ms. Ventura and she didn't.
AUSA Steiner: I'd like to address the time stamps - on security videos, they are routinely inaccurate.
Judge: The defense's concern could be allayed by inserting breaks between the clips.
AUSA: Since they will be testifying, it's hard for them to be editing the clips at the same time. We don't think it's misleading.
Judge: The defense can cross examine on this
AUSA: Given that the defense played the video of Mia's birthday video for Mr. Combs, we want to introduce recording of his jail calls about organizing social media celebrations of his birthday, which he views as a way to change the narrative
AUSA: There was someone broadcasting Mia's name just outside the courthouse - in Foley Square - yesterday. We'd ask-
[From the back of the courtroom: Diddy, their coming after you, those motherf*ckers]
Judge: Court Security Officers, escort that person out
Judge (continuing) The video timestamps... How long is it? If 40 minutes, it would be a good 403 argument.
Combs' Agnifilo: This could be an easy fix. But the witness on this will be on the stand in two hours.
Judge: Where does he live? NY?
AUSA: Florida
Judge: Bring in the jury.
All rise!
Judge: Jurors, there are some scheduling modifications including that on June 11 we will not start until 1 pm... Also June 5, from 11 to 4, and June 20, the day after Juneteenth, we'll stop at 1 pm.
Call your next witness.
