He’s “lying” but the defense did not question Cudi at all during his testimony
Judge Subramanian: I see you burned the midnight oil over the weekend. What about the DNA questions?
AUSA: Investigator Jimenez' knowledge of his is extremely limited.
Judge: But didn't he ask the serologist if any DNA test was done?
AUSA: But not the results
AUSA: Yes there was a partial profile from the glass bottle in the car. But Investigator Jimenez does not know what that means. But there-
Judge: You don't object to the report coming in, only what Mr. Agnifilo will ask?

Combs' Agnifilo: He got the results back. If the DNA came back with Sean Combs' DNA this investigation would have gone in a different direction. But it was consistent with a female contributor
Judge: So it's not whether the result was accurate, only the impact

AUSA: This DNA issue can mislead the jury
Agnifilo: We could prove this up through the serologist. This is fair game for this witness
Judge: For now the objection is overruled
Judge: What about the summary charts - when are they being offered?
AUSA: Some early next week, others along with our second to last witness before we rest our case.
